Mass. woman sues FedEx over marijuana delivery

(AP) ? A Massachusetts woman has sued FedEx, claiming the company mistakenly sent her a package containing seven pounds of marijuana, then gave her address to the intended recipients, who later showed up at her door.

Maryangela Tobin of Plymouth said in the suit filed Feb. 12 that by disclosing her address, the company violated state privacy laws and put herself and her children in danger.

"I feel like the safety of my daughters and myself was invaded and it makes things complicated," she told WBZ-TV. "I walk into my house first every time, my kids don't."

Tobin said she thought the package was a birthday present for her daughter, because when she opened it, she found candles, pixie sticks and peppermint. There was also something she thought was potpourri, but it was marijuana.

Tobin said that about an hour later, a man knocked on her door looking for the package, while two men sat in a vehicle in her driveway, waiting. She said she didn't have it, and bolted and slammed the door. Tobin claims FedEx gave out her address, which led the men to her home.

Police made an arrest, but Tobin said now she's worried about retribution.

Memphis, Tenn.-based FedEx said it doesn't comment on pending lawsuits.

With CEO Mason out, what's next for Groupon?

With a severance of $378.36, Andrew Mason could probably score several vouchers for half-priced Thai dinners or Swedish massages, but the ex-CEO of Groupon might be soured on daily deals for a while.

Analysts and investors had been predicting ? and, in some cases, hoping for ? Mason?s departure for months now. Following a dismal fourth-quarter earnings announcement Wednesday, the company?s board showed its co-founder the door.

?The only surprise here was that it took as long as it did to boot him,? Sucharita Mulpuru, analyst at Forrester Research, said via email.

?Executive Chairman Eric Lefkofsky and Vice Chairman Ted Leonsis have been appointed to the newly created Office of the Chief Executive, effective immediately, replacing Andrew Mason,? the company said in a statement. The two will serve as interim CEOs until a replacement for Mason is found.

?On behalf of the entire Groupon Board, I want to thank Andrew for his leadership, his creativity and his deep loyalty to Groupon,? Lefkofsky said in the statement. (The peculiar, precise severance package, which also includes roughly six more months of health insurance, was at Mason?s own request.)

In his typical oddball style, Mason dispensed with bland corporate-speak: "After four and a half intense and wonderful years as CEO of Groupon, I've decided that I'd like to spend more time with my family. Just kidding - I was fired today,? he wrote in a memo posted online. ?If you're wondering why... you haven't been paying attention.?

Groupon never lived up to its $20 IPO share price after it went public in November 2011. Following the news on Wednesday of an $81.1 million net loss for the fourth quarter, its stock dropped 24 percent.

The company just got too big too fast, Mulpuru said. ?They'd been set up for failure from the beginning. We'd been saying all along that there were only so many ways that you could goose up your revenue story before it caught up with you and finally it has.?

?I think his vision was correct, but you have to hold [Mason] culpable for the challenges it faced and the pressure on operations from international results,? said Tom Forte, an internet analyst at Telsey Advisory Group. ?In hindsight, the rapid pace of expansion both domestic and overseas created a business that was challenging to manage.?

Groupon also was dogged by accounting fumbles, both in the run-up to as well as after its public debut. Miscalculating how much it had to set aside for customer returns forced the company to restate its first quarterly results as a public company, which prompted a preliminary SEC probe.

Last July, Evercore Partners analyst Ken Sena raised concern that a growing part of the company?s revenue came from the lower-margin business of selling discounted products through its Groupon Goods program. ?Given that first party sales transactions assume inventory risk in addition to driving higher revenue contribution, as they are booked gross vs. net, we see the need for greater transparency,? he said at the time.

Mason was certainly part of the problem, with a penchant for self-sabotage that undermined investor confidence in his leadership abilities: At one company event attended by reporters, he memorably swigged from a beer and joked about overindulging while exhorting employees to be more disciplined.

What comes across as quirky in start-up culture can telegraph as inexperienced or immature on Wall Street, and Groupon?s stock suffered from Mason?s antics.

?He just really never fit the type of a major corporate CEO,? said Timothy Judge, a professor of management at the University of Notre Dame. ?So when people see such poor performance... they have trouble finding any reason to have faith.?

Judge said Mason?s unpolished delivery of bad news also contributed to his fall. ?We like that think we live in a world where if you?re direct and open and honest that?s the way it should be,? he said. ?I think the reality is his honesty ended up being used against him,? because investors associated Groupon?s performance with Mason?s.

Even without Mason, Groupon has an uphill climb. ?In the next couple of years, if they don?t do something else, I fully expect? the stock to become worthless, Rocky Agrawal, principal analyst at Redesign Mobile, told CNBC on Thursday.

A new CEO can bring much-needed gravitas, but will face the same big-picture problems that bedeviled Mason. ?The same challenges of slowing growth in daily deals is still there. A new CEO cannot change the market,? Edward Woo, senior research analyst at Ascendiant Capital Markets LLC, said via email.

While Mason?s replacement might be able to execute the vision of Groupon as a local e-commerce platform its founder was unable to put into action, Woo said it remains ?a tall task for anybody.?

?I think they should shrink and focus on the areas that are profitable,? Woo said. ?They should also face the possible option that their market opportunity is much smaller than they originally estimated.?

Mason did offer one final piece of advice in his departure memo, after a tangent comparing his tenure to a notoriously hard video game: ?[H]ave the courage to start with the customer. My biggest regrets are the moments that I let a lack of data override my intuition on what's best for our customers.?

Just figuring out who that is would be a good first step. ?Groupon needs to really decide who is their customer,? Mulpuru said. ?They?ve been acting like the shopper matters more. But that's what got them into this mess in the first place. They need to put the merchant first.?

SpaceX rocket develops problem mid-flight

CAPE CANAVERAL, Fla. (AP) ? A commercial vessel carrying a ton of supplies for the International Space Station ran into trouble shortly after liftoff Friday.

SpaceX's billionaire founder Elon Musk reported a problem with the thrusters on the unmanned spacecraft, named Dragon. Three of the four sets of thrusters did not kick in, he said via Twitter, and flight controllers for the company were trying to override the system.

Musk said from SpaceX Mission Control in Hawthorne, Calif., that he wants at least two thruster pods active before the twin solar panels that provide power are deployed.

NASA flight controllers in Houston offered help as they monitored space station operations.

The problem cropped up immediately following Dragon's separation from the rocket upper stage, nine minutes into the flight. The launch itself appeared to go flawlessly.

More than 1 ton of space station supplies is aboard the Dragon, including some much-needed equipment for air purifiers. The capsule is supposed to arrive at the space station Saturday morning after an unusually short chase.

This is the first major trouble to strike a Dragon in orbit. Two previous capsules, launched last year, had no problem getting to the space station.

SpaceX has a billion-dollar contract with NASA to restock the orbiting lab, and hopes the venture will lead to astronaut rides in a few years.

The private California company run by the billionaire who helped create PayPal, launched its unmanned Falcon rocket into clouds right on time. It was the third supply run by a Dragon capsule, an unparalleled accomplishment all under a year.

Launch controllers applauded and gave high-fives to one another, once the spacecraft safely reached orbit. The successful separation of the Dragon from the rocket was broadcast live on NASA TV; on-board cameras provided the unique views nine minutes into the flight.

Then the trouble struck.

The space station and its six-man crew were orbiting 250 miles above the Atlantic, just off the New England coast, when the Falcon soared. Astronauts are to use a hefty robot arm to draw the Dragon in and dock it to the station.

SpaceX tucked fresh fruit into the Dragon for the station residents; the apples and other treats are straight from the orchard of an employee's family. Also on board: 640 seeds of a flowering weed used for research, mouse stems cells, protein crystals, astronaut meals and clothing, trash bags, air-purifying devices, computer parts and other gear.

SpaceX ? formally Space Exploration Technologies Corp. ? has a $1.6 billion contract with NASA for space station shipments.

NASA's deputy administrator, Lori Garver, said using commercial providers is more efficient for the space agency. It's part of a long-term program, she noted, that has NASA spending less money on low-Earth orbit and investing more in deep-space missions. That's one reason why the space shuttles were retired in 2011 after the station was completed.

The goal is to have SpaceX and other private firms take over the job of ferrying astronauts to and from the space station in the next few years.

SpaceX ? so far the leader of the pack ? is aiming for a manned Dragon flight by 2015.

This is the second in a planned series of 12 SpaceX deliveries under the contract with NASA; the first was last October. A company-sponsored demo mission kicked everything off last May.

Competitor Orbital Sciences Corp. has yet to get off its Virginia launch pad. The company plans to launch a free-flying test of its Antares rocket and Cygnus supply ship in April, followed by a demo run to the space station in early summer. Then the so-called operational supply runs can begin.

Russia, Japan and Europe regularly make station deliveries as well, and Russia is the only option for astronaut rides. But only the Dragon is designed to bring back substantial amounts of research and used merchandise.

This Dragon is scheduled will spend more than three weeks at the space station before being cut loose by the crew on March 25. It will parachute into the Pacific with more than a ton of medical samples, plant and cell specimens, Japanese fish and old machinery, and used spacewalking gloves and other items.

SpaceX plans to launch its next Dragon to the station in late fall.

More than 2,000 guests jammed the Cape Canaveral launch site Friday morning to watch the Falcon take flight. It wasn't much of a show because of all the clouds.

Elephants Vanish in Congo Reserve

The Okapi Faunal Reserve was thought to be a safe haven for forest elephants in the otherwise conflict-stricken eastern region of the Democratic Republic of Congo. But a new report finds that unabated poaching has sent the population into serious decline. Just 1,700 elephants are left inside the reserve, and that number could be zero within 10 years, conservationists warn.

A lucrative black-market trade in ivory drives the hunt for elephants in the region. In the last 15 years, 75 percent of the Okapi population, or 5,100 animals, have been killed, and in the last five years, the population has declined 37 percent, according to a Wildlife Conservation Society's (WCS) survey.

WCS officials say the numbers are surprisingly grim because the Okapi Faunal Reserve, a UNESCO World Heritage Site covering more than 5,000 square miles (14,000 square km), is considered the best protected conservation area in the Democratic Republic of Congo. Before a civil war broke out in the region in the late 1990s, the WCS counted about 6,800 forest elephants in the reserve. In 2007, after the war officially ended, the WCS's elephant count was down to 2,700.

Since then, park rangers have reduced the number of elephants killed in the reserve each year from 400 to 170, but conservationists warn that instability in the Ituri region could spell more trouble for the animals. In one unsettling incident last June, armed attackers descended on the park headquarters, killing park rangers and villagers and looting the park's offices before setting them ablaze. The WCS says it's working with the country's wildlife department (the Institut Congolais pour la Conservation de la Nature, or ICCN) to keep the reserve secure.

"We salute our partners at ICCN for their dedication and commitment to protect wildlife under the most difficult circumstances," James Deutsch, executive director for the WCS's African programs, said in a statement. "We remain stalwart in our partnership with them and will continue to work in their country to protect elephants and the landscapes where they live. We urge the international community to support the DRC in the fight against the threat of extinction of the forest elephant."

On the other end of the ivory trade, the WCS says more work is needed to plug the demand for ivory, especially in East Asian countries like China.

The forest elephant is a subspecies of the African elephant, which is listed as vulnerable by the International Union for Conservation of Nature (IUCN). In addition to poaching, the massive mammals are threatened by habitat loss and fragmentation.

(AP) ? A combative President Barack Obama blamed Republican lawmakers Friday for failing to stop automatic spending cuts from beginning to kick in late in the day, arguing he can't perform a "Jedi mind meld" to get Republicans to agree on a deal. But he and GOP leaders displayed no appetite for letting the fight shut the government down later this month.

Meeting on the day that $85 billion in federal spending cuts were to begin to take effect, the nation's top government officials made no progress on how to avoid what they all agreed would be damaging reductions in defense and domestic spending.

Obama conceded after the session that he hadn't been able to persuade Republicans to accept his proposal to reduce deficits with a blend of tax hikes and long-term reduction in entitlement spending.

Pressed on whether he bears some responsibility for the stalemate, Obama expressed frustration ? and mixed his sci-fi metaphors.

"I'm presenting a fair deal, the fact that they don't take it means that I should somehow, you know, do a Jedi mind meld with these folks and convince them to do what's right," Obama said. The Jedi reference comes from Star Wars, and the mind meld from Star Trek.

Still, following a nearly hour-long meeting in the White House, Obama and the top four leaders in Congress generally agreed not to create a crisis out of a March 27 deadline when federal authority to spend on government operations runs out.

"It's the right thing to do to make sure we don't have a government shutdown," Obama said following the meeting. "And that's preventable."

Republican House Speaker John Boehner's office said participants in the meeting agreed legislation should be enacted this month to continue government operations while lawmakers and the administration work separately to find ways to replace the automatic cuts.

The cuts were to take effect by the end of Friday despite a parade of administration officials warning of grim consequences.

But while Obama called the cuts "dumb" and predicted they would hurt the economy, he also said: "This is not going to be a apocalypse."

Obama is seeking a big fiscal deal that would raise taxes and trim billions from expensive and ever-growing entitlement programs. But with automatic federal spending cuts ready to start taking their toll, the path toward that grand bargain Obama campaigned on last year has significantly narrowed.

"The president got his tax hikes on January First," Boehner said bluntly after the meeting. "The discussion about revenue in my view is over. It's about taking on the spending problem here in Washington."

For Obama, Friday's session was the first opportunity this year to spell out his 10-year, $1.5 trillion deficit reduction plan in a face-to-face meeting with congressional allies and adversaries.

His chances are squeezed by anti-tax conservatives, by liberals unwilling to cut into Medicare and Social Security, and by a Republican leadership that has dug in against any new revenue after acceding to Obama's demands two months ago for a higher tax rate for top income earners.

The White House is still betting that once the public begins to experience the effects of the $85 billion in cuts the pain will be severe enough to force lawmakers to reconsider and negotiate. But the consequences of the cuts ?the so called sequester ? are likely to be more of a slow boil. Obama this week said the effect "is not a cliff, but it is a tumble downward."

Indeed, much of the impact won't be felt for weeks or more than a month; some effects, like possible teacher layoffs, wouldn't take place until the new school year in the fall.

Polls also show that the public is not as engaged in this showdown as it has been in past fiscal confrontations. And an NBC-Wall Street Journal survey indicates that Obama has lost some ground with the public on his handling of the economy.

Still, White House officials also say they believe Republicans will once again give way to additional tax revenue in part to avoid drastic cuts and in part to win reductions in Medicare and Social Security spending from Obama that they have been unable to get from Democrats before.

Given Washington's entrenched partisanship, Obama's effort could be dismissed as either another failed attempt at negotiations or as simply an effort to lay blame on Republicans for blocking compromise.

The odds aren't with the president.

Many conservatives are willing to accept the automatic cuts as the only way to reduce government spending, even though the budget knife cuts into cherished defense programs. Likewise, many liberals are beginning to embrace the cuts as a way to protect revered big benefit programs that have long been identified with the Democratic Party.

Moreover, many programs for low-income Americans are protected from the immediate cuts while the Pentagon ? whose budget has long been a target of the left ? faces across-the-board cuts of 8 percent and up to 13 percent in some of its accounts.

More than 20 Democrats in Congress, including veteran Rep. Ed Markey, a candidates for the Senate from Massachusetts, have signed a letter pledging not to cut Medicare, Medicaid or Social Security benefits in efforts to reduce the deficit.

Obama's plan calls for $580 billion in new revenue over 10 years by limiting the value of itemized deductions and certain tax exclusions to no more than 28 percent. That means taxpayers with a tax rate greater than 28 percent would face a tax increase.

While Obama also regularly talks about closing loopholes to gain more revenue, his tax plan would close many corporate loopholes to lower corporate tax rates, not to generate more revenue. He aims to drop corporate tax rates from 35 percent to 28 percent for most corporations and down to 25 percent for manufacturers.

In exchange for new tax revenue and a tax overhaul, Obama has offered to reduce spending in health care programs such as Medicare by $400 billion over 10 years, change an inflation formula for government benefits that would result in lower cost-of-living adjustments for Social Security and other programs, and reduce other spending for total reductions of $900 billion over 10 years.

Those cuts, together with about $2.5 trillion in deficit reduction already achieved over the past two years through spending cuts and a year-end tax increase on taxpayers making more than $400,000 would achieve a $4 trillion deficit reduction target.

Republicans though are unimpressed, and Boehner rejected the plan when Obama first offered it in December.

At the other end of the spectrum, liberals are seeking to silence White House talk about cutting entitlements.

"They're almost on a daily basis talking about Social Security benefits," said Adam Green, founder of the liberal Progressive Change Campaign Committee. "There's no rational or political reason to do so, except some ill-conceived idea that Americans would value a grand bargain, even one that robs their grandparents of thousands of dollars."
